Terms and Conditions for Seabrook Lodge
By making a reservation you are entering into a legal short term rental contract with Seabrook Lodge, and therefore agree to and are bound by Seabrook Lodge’s terms and conditions as set out below:
Terms and Conditions of Rental
1. These terms and conditions are applicable to all Guests staying at Seabrook Lodge.
2. Guests must notify Seabrook Lodge within two (2) hours of arrival if there is any existing damage to the property or any notable conditions of concern.
3. Guests understand that they are responsible for the cost of any damages sustained to the property, décor or its contents during their stay - this includes the moving of items including furniture & accessories, damage, breakage or any excessive cleaning charges incurred during or following their stay.
4. Seabrook Lodge reserves the right to change or withdraw the terms and conditions of any reservation or confirmed booking at any time.
Payment Terms and Conditions
1. When the reservation or confirmed booking is made, a deposit payment of 50% of the total rental costs is required.
2. The final 50% payment is due 30 days before the arrival/check in date. The final payment will be billed to the credit/debit card on file unless other payment arrangements have been made.
3. A Damage deposit of €500 is required and billed to the credit/debit card on file on your check in date. The Damage deposit may be used to cover damage, breakages, additional or unauthorised guests, late check out fees and/or loss or damage to any of the home’s contents. The Damage deposit less any such charges will be refunded back to the Guest as soon as Seabrook Lodge has completed its internal inventory and occupancy report. Refunds will be processed within 30 days after the Guests’ check out date. Guests are liable for all damage and loss to the vacation home during their stay, including loss of future rental fees if the property is not available due to repairs of any serious damage or defects.
Property Occupancy Terms
1. Occupancy may not exceed 12 guests or the number of guests stated on your reservation, whichever is less. The maximum occupancy excludes children/infants under the age of two years old. A maximum of two children/infants under the age of two years old are permitted.
2. The property is provided for general vacation use only. Vacation rentals may not to be used for parties, events or group gatherings without the written consent of Seabrook Lodge and under no circumstances may exceed the maximum occupancy stated on your booking confirmation. Only Guests’ whose names are on the Rental Agreement are authorized to stay in the home. Any Guest having events or group gatherings in the home or exceeding the numbers of authorized Guests may, at the sole discretion of Seabrook Lodge, be immediately evicted without a refund.
3. The Guest agrees to abide by all the House Rules, including but not limited to a check in and check out times and no parties/events policy. Note, the property is guarded by CCTV cameras 24/7 to monitor security as well as property access.
4. If during the rental period, any law or house rule is violated, or the property is used for any immoral purpose, occupancy will be immediately terminated without a refund.
5. The Guest making the reservation (AKA the Lead Guest) must be 25 years of age or older and must occupy the rental property for the entire term of stay booked for the reservation. They are the responsible party for any damage, loss or additional costs incurred to be paid to Seabrook Lodge. The Name on all documents, credit/debit card being used, Name on Photo I.D., Name on Billing Statement, MUST MATCH the Name of the Lead Guest on the reservation making the payment.
6. The reservation is accepted and confirmed only for the number of Guests declared on the Reservation or Booking Confirmation. Seabrook Lodge reserves the right to cancel the reservation if additional Guests are added without prior consent, or if the home is over-occupied. An additional charge of €50 per additional guest, per night, shall be charged for any and all additional guests that stay on the property WITH the prior approval of Seabrook Lodge. An additional charge of €100 per additional unauthorised guest, per night, shall be charged for any additional guests that stay on the property WITHOUT the prior approval of Seabrook Lodge. The €100 per night/per unauthorized guest shall be applicable for every night included and booked under your reservation.
7. Seabrook Lodge and/or the Property Owner(s), follow best-in-class guidelines to guests in an effort to have a peaceful and memorable stay. In order to do so, the property may or may not have Smart Home technology installed. Our goal is to be proactive in order to improve the best possible guest experience and prevent problems before they arise. Smart Home technology is; – Remotely monitored thermostats & controls – Remotely monitored front and back door access – Remotely monitored CCTV security system – as deemed necessary by Seabrook Lodge.
8. The Lead Guest will be fully responsible for all damage charges, which will be processed onto the Lead Guest’s credit/debit card on file. Seabrook Lodge reserves the right to exercise any legal remedies to pursue the amount owed from the Guest that exceeds the Security Deposit.
9. Intentional damage, theft or gross negligence that may also be considered criminal damage, will result in a report being made to An Garda Siochána and possible legal action being taken.
10. Guests are advised to take out their own travel insurance during their stay to cover any damages that may be caused by other guests in their group.
Cancellation Policy
1. All cancellations must be received in writing. No cancellation charge applies if your reservation is cancelled within 48 hours of booking, unless your arrival date falls within 48 hours of booking, then no cancellation is permittable. Beyond that time, a 50% refund will be issued for callcelations made more than 90 days prior to your arrival date. Any cancellations made within 90 days of your arrival, will require the full amount of the booking to be charged.
2. The Guest may be offered the option to change their dates with the prior written approval of Seabrook Lodge. Otherwise the dates of the reservation cannot be changed, doing so would effectively cancel the original reservation, and so the cancellation policy would apply.
3. If the length of stay is reduced from the original dates, the cancellation policy will apply to the nights that have been canceled.
4. Cancellation of the reservation/booking due to non-payment of the balance by the due date, will result in the loss of all monies.
5. Seabrook Lodge regrets that they are unable to waive any of the cancellation charges above, whatever the circumstances.
6. We strongly recommend that Guests take out appropriate travel insurance to cover them against unforeseen cancellations for your stay at Seabrook Lodge. Travel Insurance can also cover risks incidental to planned travel such as sickness, accidental injury, or death of you or a family member (or of a traveling companion), weather delays, natural disasters, unexpected changes in your employment, and many more specified reasons.
Limitation of Liability
1. Community and home amenities are used at the Guest’s own risk. Guest should exercise caution when using stairs, showers, bathrooms, gas stove, ovens, insinkerator, fireplaces, electrical devices, outdoor fire pit, outdoor fireplace, outdoor furniture, lawn areas, patios, driveways and walkways. Seabrook Lodge and the Owner(s) accept no reasonability for any personal loss, injury or illness, and shall not be held liable for the personal safety of the guest or their travel party.
2. Seabrook Lodge and/or the Owner(s) do not accept liability for equipment failure and/or services at the Property. In the event of failure of equipment, the Guest must notify Seabrook Lodge within 24 hours, so that Seabrook Lodge may elect how best to rectify the failure.
3. Seabrook Lodge and/or the Owner(s) do not accept liability for any lost or stolen personal property of the Guest(s) within the Property during the rental period. In the event that property of the Guest(s) is lost or stolen, the Guest(s) should advise the appropriate authority first, and then contact Seabrook Lodge to report the lost or stolen items.
4. The Lead Guest must ensure that children are supervised at all times. It is the policy of Seabrook Lodge that all children under the age of 18 years are not left in the rental home un-supervised at any time during the rental period.
5. Games, toys, baby furniture/equipment, strollers, travel cribs and high chairs are all used at the Guests’ own risk.
6. Seabrook Lodge does not accept liability for acts of violence, God, nature, fire, flood, war, civil disobedience, riot, or other force majeure that may have a deleterious effect on the Guest.
7. We cannot accept any liability for the failure of supplies and utilities such as water, electricity, BBQ gas or WiFi/telephone/internet services. We cannot accept any liability for the heating system, or any household appliance breaking down. Urgent steps will be taken for a local engineer to rectify any problem.
8. We accept no responsibility of liability for any loss or damage or alteration in the terms of your reservation caused by events beyond our control, including, but not restricted to war, terrorist activity, civil commotion, flight delays or cancellations airport closure, adverse weather conditions, fire, flood or industrial dispute. There will be no credit given for shortened stays due to late arrival or early departure for any reason and no credit given for cancellation due to weather conditions.
9. The use of the BBQs is at the Guests own risk and Seabrook Lodge cannot accept any responsibility for injury of any kind that may arise from the use of the BBQ, fire pit or fireplace. The Guest takes full responsibility for the connection of BBQ gas cylinders/bottles. Guests should also remember to keep children away from BBQs, fire outs and fireplaces whether in use or not.
10. Failure to comply with any of the terms herein will at the sole discretion of Seabrook Lodge, result in the eviction of the Guest from the Property, without a refund.
Force Majeure
1. There may be circumstances beyond our control, in which the property might not be available for your reservation. Examples of these, but are not limited to, destruction of property, sale of property, construction nearby water, gas or sewer leaks, fire or any other damage to the property making it inhabitable or potentially inhabitable.
2. In the event of Force Majeure, Seabrook Lodge will do their best to make alternative arrangements. If these alternative arrangements are not acceptable to the Guest, then Seabrook Lodge will refund all monies paid. If the Guest accepts the alternative accommodation, they also agree to re-locate back to the original property when it is deemed available by Seabrook Lodge. This will be the full extent of our liability to the Guest, and we will not be responsible for any other costs connected with any such cancellation howsoever arising.
Reservation General Terms and Conditions
1. Smoking is not permitted in the property at any time. In the event that a Guest is found to have smoked in the property, the Lead Guest will be responsible for any charges related to the cleaning/deodorizing of the property and all items in the property (i.e carpets, furniture, window treatments, etc). These charges will be applied to the credit/debit card on file for the reservation/booking.
2. Up to (2) Pets are only permitted on the property with the prior authorisation of Seabrook Lodge. Seabrook Lodge shall not be responsible for any loss or injury to a pet while staying at the property, or for any action taken against the pet or pet owner by third parties.
3. All property descriptions given on the website(s) are made in good faith. Seabrook Lodge and the owner(s) of the property accept no liability whatsoever for errors or omissions.
4. The Guest agrees the rental period will begin and end on the dates as shown on the reservation or booking confirmation.
5. Occupancy of RV campers, caravans, enclosed trailers and/or tents on the premises is strictly prohibited.
6. The reservation or booking of Seabrook Lodge may not be assigned to a third party nor shall the property be sublet. No locks must be broken, changed or added.
7. Seabrook Lodge comes complete with a fully equipped kitchen including a refrigerator, freezer, oven, stove, microwave, dishwasher, toaster, coffee maker, cookware, dishes, glasses, utensils, linens, and towels. The property also includes a full-size washer and dryer, iron, ironing board and a number of hairdryers. While bath and hand towels are provided, you may want to bring your own beach towels and washcloths, as these are not supplied in the property.
8. Please understand that vacation homes are self-catering accommodations. Seabrook Lodge provides complimentary starter soap, toilet paper, and trash bags. Once these items are used, it is the Guest’s responsibility to replenish them.
9. The Guest is hereby granted a one time license to use the premises. The Guest acknowledges and agrees that no form of tenancy has been created by the Guest’s use of the premises.
10. Any disputes under this Agreement, shall be resolved exclusively via binding arbitration. Each party shall pay their own attorney fees/costs.
11. In the event a Guest leaves any personal item(s) behind in the vacation rental property, we will do our best to locate the item(s).
12. Seabrook Lodge are not responsible for any losses under any circumstances. If the item is found, the Guest will be advised and be solely responsible for any cost incurred including packaging and postage.
Check-In
1. Check-In time is 4:00 PM
2. An early arrival can only be arranged for an additional fee of €100 if the home does not have another Guest’s departure scheduled on the same day. This option must be arranged in advance and cannot be added on the day of arrival.
3. No refunds will be given for late arrivals, early departures or unused days of your rental property reservation.
Check Out
1. Check out is before 10:00 AM. A late check out can only be arranged for an additional fee of €100 if the home does not have another Guest’s arrival scheduled on the same day. This option must be arranged in advance and cannot be added on the day of departure.
2. You are not required to clean the home or wash the linens or dishes. However, there will be an additional cleaning fee if the home is left in a condition that would require an excessive or additional cleaning.
3. You are required to take out your rubbish to the outdoor bin(s) provided.
4. In the event a Guest fails to depart from the home by 10:00 AM with no late check out arranged and results in Seabrook Lodge being unable to clean and prepare the home for the next arriving Guest that day, the departing Guest agrees to pay all damages and costs incurred by Seabrook Lodge including but not limited to compensation to the next arriving Guest.
5. No refunds will be given for late arrivals, early departures or unused days of your rental property reservation.
Service Level
1. Seabrook Lodge agrees to the Service Level for the remedy of any problems found at the property, either on arrival of the Guest, or during the rental period as follows.
2. Any problems that arise during the Rental Period that do not constitute as an emergency, as determined by Seabrook Lodge, will be remedied during or after the Rental Period, based on the severity of the problem, and at the sole discretion of Seabrook Lodge.
3. Any problems regarding the vacation home should be directed to our office. Our email is [email protected] Our business hours are 9:00 AM to 5:00 PM 7 days a week. Evenings we are available for emergencies only. If due to the fault of the Guest, and at the discretion of Seabrook Lodge, there could be a service fee applied any time Seabrook Lodge and/or its representatives or maintenance team is called out to the property after hours.
4. Seabrook Lodge and/or its representatives or maintenance team may enter the property at any time, without notice, for the purpose of protection and/or maintenance of the property. Whenever possible, Seabrook Lodge will provide notice to the Guests prior to such entrance.
